Ltd., its subsidiaries, and affiliates (' Megaplastic ') require that all the visitors to or users ('Users') of its site(s) on the World Wide Web (the Site) adhere to the following Terms Of Use. By using and/or accessing the Site, you (a User for the purposes herein) signify your agreement with these Terms Of Use and your acceptance of the terms and conditions therein. Megaplastic reserves the right, in its sole discretion, to change, modify, alter, revise, and/or otherwise update these Terms Of Use at any time and you agree to be bound by any and such changes, modifications, alterations, revisions, and/or updates. 1. Laws and Regulations User access to and use of the Site is subject to all applicable international, national, state, and local laws and regulations. 2. Limitation of Liability for Use of the Site and Linked Sites The information, software, products and descriptions of services published on the Site or a Linked Site may include inaccuracies or typographical errors, and Megaplastic specifically disclaims any liability for such inaccuracies or errors. Changes are periodically made to the information on the Site and Linked Sites. Megaplastic may make improvements or changes to the Site at any time. You agree that Megaplastic, its affiliates, and any of the respective officers, directors, employees, or agents will not be liable, whether in contract, tort, strict liability, or otherwise, for any actual, direct, punitive, special, consequential, incidental, or indirect damages (including, without limitation, lost profits, cost of procuring substitute service(s), or lost opportunity) arising out of or in connection with the use of the Site or a Linked Site or with the delay or inability to use the Site or a Linked Site, even if Megaplastic is made aware of the possibility of such damages. This limitation on liability includes, but is not limited to, the transmission of any viruses which may infect a user's equipment, failure of mechanical or electronic equipment or communication lines, telephone, or other interconnection problems, unauthorized access, theft, operator errors, strikes or other labour problems, or any force majeure. Megaplastic cannot and does not guarantee continuous, uninterrupted, or secure access to the Site. 3. Limitation of Liability for Services arranged through the Site You agree that Megaplastic is a mere agent for the providers of services available through the Site. Any and all claims regarding any failure or breach with respect to the services offered through the Site are limited to claims against any and all service providers. Megaplastic hereby disclaims any liability, whether based on contract, tort, strict liability, or otherwise, including, without limitation, liability for any actual direct, punitive, special, consequential, incidental, or indirect damages, in connection with the goods or services provided by any carrier or other supplier through the Site, including, without limitation, liability for any act, error, omission, injury, loss, accident, delay, or irregularity which may be incurred through the fault, negligent, or otherwise, of such carrier or supplier; and you hereby exonerate Megaplastic from any liability with respect to the same. 4. Confidentiality of User Communications Megaplastic is very respectful about the privacy concerns of the Users of its Site, and as a general policy, no personal information is automatically collected from the Users. However, certain non-personal information of Users is recorded by the standard operation of Megaplastic's Internet servers. This information is primarily used to provide an enhanced online experience for the User. Information tracked includes the type of browser being used by the User (e.g., Netscape, Internet Explorer), the type of operating system (e.g. Macintosh, Windows) in use by the User, and the domain name of the User's Internet service provider (e.g., America Online, Netvigator). By having this information, web pages optimized for a particular User's computer is automatically available to that User. Other uses of this information include internal review of the number of Users of the Site, but only in an aggregate and non-personally-identifiable form. E-mail addresses and other personally identifiable data about Users to this site are known to Megaplastic only when voluntarily submitted. Personally identifiable information that may be collected in connection with Users voluntarily filling out contest entry forms or subscribing to newsletters is retained by Megaplastic and not sold or otherwise transferred outside the Company. This information is used to better understand Users' use of the Sites and to support transactions made on the Sites. Except as required by law, Megaplastic will maintain the confidentiality of all User communications which contain personal User information and which are transmitted directly to Megaplastic. However, this data in an aggregate form may be provided to other parties for marketing, advertising, or other uses. Megaplastic may also use e-mail addresses and other personally identifiable information to contact Users who communicate with Megaplastic. For example, Megaplastic directs e-mail to Users who provide Megaplastic with their e-mail addresses for specific purposes such as receiving Megaplastic's e-mail newsletters or being notified if they have won one of its contests. Each e-mail newsletter always contains instruction on how to discontinue receipt of the newsletter. As well, you acknowledge that Megaplastic may use and provide information contained in any information you provide to Megaplastic, through the Site or otherwise, (including any ideas, concepts, know-how or other intellectual property) to any of its parent company, subsidiaries, and/or affiliates for any purpose whatsoever and as deemed appropriate by Megaplastic. User should be aware that Linked Sites may contain confidentiality provisions that differ from the provisions provided herein. Megaplastic is not responsible for such provisions, and expressly disclaims any and all liability related to such provisions. 5. Use oF 'Cookies' Megaplastic reserves the right to store information on a User's computer in the form of a 'cookie' or similar file for purposes of modifying the Site to reflect Users' preferences. The cookie itself does not contain any personally identifying information. 6. Submissions Any notes, message/billboard postings, ideas, suggestions, concepts or other material submitted will become the property of Megaplastic throughout the universe and Megaplastic shall be entitled to use the material for any type of use forever including in any media whether now known or hereafter devised. When you submit material to Megaplastic's Sites, you agree that Megaplastic has the right to publish the material for any type of use as outlined above including promotional and advertising purposes. 7. Linked Internet Sites Megaplastic prohibits caching, unauthorized hypertext links to the Site and the framing of any Content available through the Site. Megaplastic reserves the right to disable any unauthorized links or frames and specifically disclaims any responsibility for the content available on any Linked Sites, whether or not Megaplastic is affiliated with such Linked Sites. The Linked Sites are for your convenience only and access to any Linked Site is at the User's own risk. User should be aware that Linked Sites may contain terms of use, rules and regulations, privacy provisions, confidentiality provisions, transmission of personal data provisions, and other provisions that differ from the provisions provided on the Site. Megaplastic is not responsible for such provisions, and expressly disclaims any and all liability related to such provisions. 8. Changes to Terms Of Use Megaplastic reserves the right to change, modify, alter, revise, or otherwise update these Terms Of Use at any time, at the sole discretion of Megaplastic , and Users are deemed to be apprised of and bound by any and such changes to these Terms Of Use. 9. Violation of Terms of Use Megaplastic reserves the right to seek all remedies available at law and in equity for violations of these Terms Of Use, including the right to block access from a particular Internet address to the Site. 10. Notification to PPW regarding Alleged Copyright Infringement Megaplastic reserves the right to remove any Content on the Site which allegedly infringes another person's copyright. Notices to Megaplastic regarding any alleged copyright infringement on the Site should be directed to Megaplastic's Head Office at info@ppgl.com 11. Jurisdiction/Governing Law This agreement shall be governed by, construed and enforced in accordance with the laws of the Hong Kong Special Administrative Region and Users of the Site agree to submit to the laws of the Hong Kong Special Administrative Region without regard to conflicts of laws principles. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the matters contained herein and shall not be modified except in writing, signed by Megaplastic.
